The Citizen’s Petition to the FDA

We will file a citizen's petition with the FDA asking that the FDA immediately and expeditiously review and act on any application for EUA for a COVID-19 vaccine for children under 5, with no delay unrelated to safety or efficacy concerns. We argue that a delay for any other reason - such as "potential confusion" or any other issue related to promotion or messaging - violates section 564 of the Federal Food, Drug, and Cosmetic Act.

This is a first line legal action by our group. We will distribute the petition widely to put public pressure on the FDA. We would like to have as many petitioners as possible. Any concerned citizen can petition the FDA, and we want to make it clear how many of us are deeply concerned about their potential violation of the law.
